TAPE asks IPOPHIL to deny TVJ applications for “Eat Bulaga” trademark

Hiniling ng TAPE Inc. sa Intellectual Property Office Philippines (IPOPHIL) na huwag tanggapin ang applications nina Tito Sotto, Vic Sotto, at Joey de Leon o TVJ para sa “Eat Bulaga” rademark.

Ang TAPE ang producer ng longest-running noontime show na Eat Bulaga!, na kasalukuyang umeere sa GMA-7 at dating hinu-host ng TVJ.

Noong July 12, 2023, nagpadala ng sulat si TAPE President and CEO Romeo “Jon” Jalosjos Jr. kay Jesus Antonio Ros, director IV ng Bureau of Trademarks.

May kinalaman ang sulat sa sagot ng Bureau of Trademarks sa trademark application ng “Eat Bulaga” sa Intellectual Property Office Philippines (IPOPHIL).

Ikintutuwa ng TAPE na kinikilala ng IPOHIL ang TAPE bilang “prior registrant of the Trademark ‘Eat Bulaga,’ na lalo umanong nagpapatibay ng kanilang posisyon bilang “rightful owner” ng “Eat Bulaga” trademark.

Bahagi ng pahayag ng TAPE, “We are pleased that the IPOPHIL has duly recognized TAPE, Inc. as the prior registrant of the Trademark ‘Eat Bulaga’ with registration number 4-2011-005951. The recognition of our prior ownership establishes our position as the rightful owner of the ‘Eat Bulaga’ mark.”

Nakasaad din sa sulat ng TAPE ang kanilang kahilingan sa IPOPHIL na i-deny ang applications ng TVJ para sa “Eat Bulaga” trademark.

Ayon sa TAPE, itinanggi ng dati nilang president na si Antonio “Tony” Tuviera na alam niya at may consent siya sa pagkakasama ng kanyang pangalan sa “February 27, 2023” application ng TVJ.

Binigyang diin din ng TAPE na dalawa ang applications ng TVJ para sa ‘Eat Bulaga’ trademark: sa February 27 application ay nakapangalan ito sa TVJ, samantalang sa March 22, 2023 application ay tanging si Joey de Leon lamang ang nakapangalan.

Hindi umano nakapasa ang mga ito sa “identity of the applicant” tests, at napakapagpalito lamang kung sino sa kanila ang tunay na applicant bilang may-ari ng “Eat Bulaga” trademark.

Pahayag ng TAPE: “As regards the process, we understand that, ‘during the examination process, no attention shall be given to statements or protests of persons concerning pending applications to which they are not parties UNLESS INFORMATION SHALL HAVE BEEN VOLUNTARILY COMMUNICATED BY THE APPLICANT.’

“However, it is our humble submission that it is the recent applicants of the subject applications, Tito Sotto, Vic Sotto and Joey de Leon (TVJ for brevity), who voluntarily communicated to you the information about us.

“In fact, they even filed a petition for cancellation of our registered trademark ‘Eat Bulaga’ before the Intellectual Property Office (IPO). We mentioned applicants TVJ only because our director/stockholder and former president Antonio Tuviera VEHEMENTLY denies knowledge and consent of including his name in the February 27, 2023 application, making the February 27, 2023 application fatally defective thereby warranting the outright refusal/denial thereof by this Honorable Office.

“It has to be underscored as well that the two (2) applications bear the name of TVJ in the February 27 application then bear only the name of Joey de Leon in the second, March 22, 2023 application, as the alleged owner/applicants of ‘Eat Bulaga’ trademark, thereby failing to pass the ‘identity of the applicant’ tests, setting a confusion as to who among them is the real applicant, claiming ownership of the subject trademark.”

Dagdag ng TAPE, “With due respect, we humbly believe that said fact alone is enough to outrightly refuse/deny their applications as this examination stage as the applications fail to qualify for publication.

“In the end, we wish to convey our profound appreciation of letting us know of the rules and the process. Rest assured that we will look into it at the IPO website and we will consult a trademark lawyer so we can protect our interest/ownership over the trademark ‘Eat Bulaga’ which is ‘registered’ to us and we are ‘using’ for our noontime show for the past four (4) decades.”

Masalimuot ang usapin tungkol sa “Eat Bulaga” trademark dahil parehong naninindigan ang TAPE at ang TVJ na sila ang tunay na may-ari at may karapatan dito.

Nauna nang nagsumite ang TVJ ng petition sa Intellectual Property Office (IPO) upang kanselahin ang trademark application ng TAPE dahil “fraudulent” umano ang pagpapa-register nito.
